procedures
1) end buyer sends loi
2) seller sends fco
3) end buyer accepts fco and sends icpo with complete banking details along with rwa or bcl to seller. buyer will contact sellers bank and send bcl to confirm proof of funds.
4) after proof of funds is confirmed the seller will provide partial proof of product in the form of confirmation letter from the factory and also present the draft contract (spa) for acceptance by the end buyer. contract goes through normal negotiation and validation period 3 days or earlier.
5) end buyer returns the draft contract by exchanging it by email attachment, duly signed and sealed, with copy of trade licence and copy of buyers passport photo page.
6) seller accepts signed contract, it is returned in pdf (the email sent copy will be deemed legal until hard copies exchanged) seller will also send pro forma invoice contract is now leagally binding both parties.
7) within 5 banking days, end buyer s bank shall open swift dlc bank instrument for the value agreed, for the monthly roll over of the contract, which will run for 1 year and 1 day. payment will be via an irrevocable, revolving documentary letter of credit (dlc) payable at sight of shipping documents. (this is the payment instrument) after receiving the dlc, seller issues full proof of product and 2% performance bond to buyers bank.
8) seller to notify the end buyer of the booking and vessel details
9) the delivery and forwarding begins immediately according to the contract, buyer makes payment by mt103 for each months presentation of shiping documents seller also to inform the loading and vessel details
10) seller to send to end buyers bank copy of the port of loading documents and the originals to be sent via dhl.
11) seller pays mandate/intermediaries by tt within (3) business days from receipt of payment by buyer
